Underground storage tank (UST) facilities that are eligible to receive reimbursement from the Financial Responsibility Account (FRA) and Petroleum Storage Tank Account (PSTA) of the Petroleum Storage Tank Environmental Assurance Fund (PSTEAF) are ranked in accordance with 401 KAR 42:250 (Section 21).
The ranking system regulation (401 KAR 42:250 Section 21) establishes the criteria for ranking UST facilities according to the extent of damage to the environment, the potential threat to human health, and the financial ability of the petroleum storage tank owner or operator to perform corrective action, in order to address the completion of corrective action and the reimbursement of eligible costs.
A facility that has been ranked based upon accurate classification of the UST system will not later receive a lower priority ranking as a result of the performance of directed corrective actions.
Facility rankings may be amended if the UST Branch receives misrepresentations, or otherwise inaccurate information, or receives new information related to specific facilities.
