All state administrative regulations are available at the Kentucky Legislative Commission (LRC) website. The administrative regulations contained on the LRC website are not official versions. The official versions are contained in the Kentucky Administrative Regulations Service and in the monthly Administrative Register of Kentucky. Public Hearings

Public hearings may be subject to audio and video recording and DEP staff will attempt to correct technical difficulties as they arise during a virtual public hearing. The hearing event will be added to the EEC web calendar Calendar - Kentucky Energy and Environment Cabinet and may be cancelled if no request to participate is received by the regulation contact listed within five (5) business days prior to the public hearing date. Public comments will be considered by DEP and a formal Statement of Consideration, along with an Amended After Comments version of the administrative regulation if changes are made, will be filed with the LRC as required by KRS Chapter 13A.

DEP Regulation Tracker

Information on administrative regulations in pre-vetting stage precedes information on the proposed rules that have been filed with the LRC. No formal written response will be developed by the Cabinet at the pre-vetting stage, however, comments will be used to formulate any necessary changes before filing with the LRC. 

Explanation of stages:

  • ​Pre-vetting stage - Agency staff have drafted a proposed administrative regulation change related to DEP and have provided notice to RegWatch recipients.  This stage is a pre-filing stage and is not required by KRS Chapter 13A.  No formal statement of consideration or response to comments will be prepared by DEP.  ​

  • Filing stage - Agency staff have filed the administrative regulation for processing with LRC following the procedures identified in KRS Chapter 13A.  

  • Amended after Comments stage:  Agency staff have filed an Amended after Comments (AAC) version of the regulation with LRC, along with an attached Statement of Consideration.
