About NEPA

The Energy and Environment Cabinet serves as the state clearinghouse for environmental reviews required by the National Environmental Policy Act. The Department for Environmental Protection (DEP) is the agency assigned the duty of coordinating the review by state agencies of projects or activities of federal agencies, or the use of federal funds, that fall under the requirements of the National Environmental Policy Act. These review efforts are called the State Environmental Review Process.

Documents detailing these projects or activities are submitted to the state environmental review officer for distribution to the reviewing agencies. There are 15 state agencies that provide these reviews. The documents that are being reviewed range from the initial scoping documents of a project to the final Environmental Impact Statement (EIS) or the Finding of No Significant Impact (FONSI). In some cases documents may be resubmitted in a more refined state for further review and comments.

These documents have traditionally been routed to the review agencies that would be able to provide the expertise to evaluate the proposed project or activity and provide substantive comments back to the submitting sponsor. As coordinator of the State Environmental Review Process, DEP compiles the reviews as a single response from Kentucky state government.
