State Plans

​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​​State Air Quality Plans​​​​​​​

State plans fall under Section 111(d) of the Clean Air Act​​. Each plan sets performance standards for certain facilities for specific pollutants. The Energy and Environment Cabinet (EEC) ensures these standards are implemented and enforced. The information below summarizes Kentucky's state plans with relevant information and updates about each plan.

​​Kraft Pulp Mills - 401 KAR 61:025​

​​​​​​Kraft pulp mills are facilities that convert wood into pulp through a chemical process known as the kraft process. Kraft pulp mills emit particulate matter (PM), sulfur compounds, and other pollutants. (EPA's) New Source Performance Standards (NSPS) for Kraft Pulp Mills were amended in 2014.​

​​​​Municipal Solid Waste Landfills - 401 KAR 61:036

​In 2016, EPA announced final updates to its NSPS to reduce emissions of methane-rich landfill gas from new, modified, and reconstructed municipal solid waste (MSW) landfills. In a separate action, EPA also issued guidelines for reducing emissions from existing MSW landfills.​

Primary Aluminum Reduction Plants - 401 KAR 61:165

Primary aluminum reduction plants electrolyticall​y reduce refined bauxite to form aluminum. EPA finalized emissions standards for primary aluminum reduction plants in 1997.​

​​Sulfuric Acid Plants - 401 KAR 61:030

The NSPS for Sulfuric Acid Plants regulate emissions of PM, sulfur dioxide (SO2), nitrogen oxides (NOx), and sulfuric acid (H2SO4) mist from sulfuric acid production facilities.​​​​


​Negative Declarations​​​​

​​​A negative declaration is found in 40 CFR Part 62 Subpart S-Kentucky​. It is an official statement made by the cabinet after reviewing a proposed development project. Based on their initial environmental review, it has been determined that the project will not have a significant adverse effect on the air quality.​
