​401 KAR Chapter 45 Administrative Regulations

​The Kentucky Energy and Environment Cabinet cancelled the public​ hearing scheduled to be held on November 21, 2023 at 5:30 p.m. (ET), pursuant to KRS 13A.270, as no requests to attend were received.

These changes are necessary to comply with amendments to KRS 224 Chapter 50 related to the passage of SB 213 from the 2023 Legislative Session. This regulatory package includes eleven amended administrative regulations and one new administrative regulation and relates to the land application of bios​olids. The administrative regulation package was filed with the Legislative Research Commission on January 10, 2024.

​​​Public Comment Period Amendments

​​​The Kentucky Department for Environmental Protection filed the following proposed amended after comments administrative regulations and statement of consideration. The amendments to the administrative regulations were made in response to comments received during the public comment period. The Kentucky Department for Environmental Protection filed the proposed administrative regulations with the Legislative Research Commission on January 10, 2024. The administrative regulations were heard at the March meeting of the Administrative Regulations Review Subcommittee; where the committee reported favorably. Once referred to the subject matter committee, the committee will have 90-days to review. Please continue to check the Legislative Research Commission's webpage for the final schedule. Below are links to the two amended after comments administrative regulations and the forms that were also amended in response to comments.

401 KAR Chapter 103 Administrative Regulations

​​​The Kentucky Energy and Environment Cabinet cancelled the public​ hearing scheduled to be held on December 21, 2023 at 10:00 a.m. (ET), pursuant to KRS 13A.270, as no requests to attend were received.

These administrative regulations are necessary to comply with amendments to KRS Chapter 224 and KRS Chapter 278 related to the passage of HB 4 from the 2023 Legislative Session. This regulatory package includes four new administrative regulations and relates to monitoring and enforcement requirements for obligations set forth in KRS Chapter 224 and KRS Chapter 278.  The proposed administrative​ regulation package was filed with the Legislative Research Commission on September 25, 2023.
