An owner, operator, lessee or licensee of each mine is required to procure a license annually from the Division of Mine Safety. A license must also be procured prior to operating a mine if an owner, operator, lessee or licensee  assumes control of a mine, opens a new mine or reopens an abandoned mine during any calendar year.

The Division of Mine Safety (DMS) maintains a list of coal mines licensed annually.
