​​​Construction Permits

State regulation 401 KAR 5:005 requires that a  permit be issued by the Division of Water (DOW) prior to start of construction on wastewater collection systems and wastewater treatment plants.  Prior to issuing a construction permit, the DOW reviews plans and specifications with respect to sanitary features of design.

Regulations and Requirements

Regulation 401 KAR 5:005 lists the fees and requirements for the design, construction and approval of clean water collection systems. The designs and specifications shall also meet the requirements contained in 401 KAR 5:005 and the 2014 edition of  Recommended Standards for Wastewater Facilities, also referred to as Ten State Standards.

Electronic Submittals

As of December 9, 2017, construction applications must be submitted to the Division of Water electronically via MyKentucky.gov. Electronically submitted plans must meet the requirements of 201 KAR 18:104 regarding the use of digital signatures for Professional Engineers.

Line Extension Bans

If the facility is under a line extension ban, a “Line Extension Ban Exemption Request Form” [82 KB] will need to be prepared and submitted. See the Wastewater Municipal Planning page for additional information.​
